He based his argument on the 1987 Constitution, noting that the Vice President is an impeachable official, similar to the President. According to Padilla, the impeachment process serves as the exclusive constitutional method for addressing political accountability and potential removal from office for impeachable offenses. To support his position, the senator referenced a 2005 Supreme Court decision, which he claims establishes legal limitations on prosecuting impeachable officers for criminal acts that could also serve as grounds for impeachment during their tenure.
