The European Court of Human Rights has issued a unanimous ruling stating that Turkey infringed upon the rights of 26 individuals imprisoned following the 2016 coup attempt. These individuals were held in pre-trial detention for up to 11 months on accusations of involvement with the Gülen movement. The Strasbourg-based court determined that Turkish judicial authorities breached Article 5 of the European Convention on Human Rights by failing to provide adequate, individualized justifications for the continued incarceration of the applicants. Instead of conducting specific assessments, local courts relied on generalized and repetitive reasoning to maintain the detention of these suspects. While most of the individuals involved were later convicted of belonging to an armed terrorist organization, the court emphasized that the initial detention procedures lacked the necessary legal rigor required to protect the right to liberty and security.
