The newly formed Federal Constitutional Court (FCC) has issued a formal ruling defining its jurisdictional independence from the Supreme Court. In an eight-page document penned by Justice Aamer Farooq, the court clarified that while previous Supreme Court decisions may offer useful legal guidance, they do not constitute binding precedents for the FCC. The three-member bench emphasized that the FCC maintains its own authority, particularly regarding appellate jurisdiction and review petitions. While the court acknowledged that it might incorporate Supreme Court jurisprudence when such legal reasoning aligns with constitutional principles, it is not obligated to follow these precedents. This decision reinforces the FCC's position as an apex judicial body, asserting its autonomy in interpreting the law and the Constitution independently of the Supreme Court's established legal frameworks.
