The Federal Constitutional Court (FCC) has voiced significant concerns regarding the Supreme Court's decision to revisit a case that had already been finalized. Chief Justice Aminuddin Khan, presiding over a two-member bench alongside Justice Ali Baqar Najafi, noted that the actions taken by Justice Munib Akhtar challenge established legal norms and institutional standards. The court emphasized that reopening a matter while a previous ruling remains active and subject to ongoing review processes undermines judicial discipline. This observation emerged during the hearing of multiple petitions contesting a December 2021 Supreme Court judgment, which had refused to grant leave to appeal in litigation originating from a 2020 Sindh High Court verdict concerning constitutional validity. The FCC highlighted the importance of maintaining procedural consistency and respecting settled judicial determinations to preserve the integrity of the legal system.
