The Federal Constitutional Court of Pakistan has issued a ruling stating that individuals should not be permanently disqualified from government service due to minor or less significant criminal offenses. In a four-page judgment written by Justice Ali Baqar Najafi, the court emphasized that the consequences of a past transgression must remain proportionate. The bench, led by Chief Justice Amin-ud-Din Khan, supported a previous Peshawar High Court decision that ordered the Khyber Pakhtunkhwa government to evaluate a candidate for a police constable position despite his criminal record. The court noted that while illegal acts are serious, authorities must assess the specific nature of the offense, the individual's character, and the probability of future criminal behavior rather than applying an automatic, permanent ban on public sector employment.
